Abstract

General <br>A. The processing of garnishment orders for child support and/or alimony from the pay of individuals receiving remuneration for employment from the United States is governed by Title 42, United States Code, section 659 (<em><u>42 U.S.C. 659</u></em>) and Title 5, Code of Federal Regulations, Part 581 <u><em>(5 C.F.R. Part 581</em></u>). The purpose of this section is to provide information unique to the collection of child support and/or alimony from the pay of active duty members and members of the Reserve Components. The provisions of 42 U.S.C. 659 and 5 C.F.R. Part 581 take precedence when in conflict with this chapter. <br>B. Moneys due from or payable by the United States to active duty members and members of the Reserve Components not on active duty are subject to legal process to enforce a legal obligation to pay child support or alimony. Legal process issued by foreign courts may be honored under this authority if issued by a court of competent jurisdiction of a country with which the United States has an agreement which requires the United States to honor such process. Such an agreement has been reached with the Federal Republic of Germany. When the law of the state or foreign nation in which the issuing court is located conflicts with the federal law, the more restrictive law applies.
