Separation of Regular and Reserve Commissioned Officers

Abstract: PURPOSE. This Instruction:
a. Reissues DoD Directive (DoDD) 1332.30 (Reference (a)) as a DoD Instruction (DoDI) and incorporates and cancels DoDI 1332.40 (Reference (b)) in accordance with the authority in DoDD 5124.02 (Reference (c)).
b. Implements chapters 60 and 1411 of title 10, United States Code (U.S.C.) (Reference (d)) by establishing DoD policy, assigning responsibilities, and prescribing procedures governing the administrative separation of Regular and Reserve commissioned officers for substandard performance of duty, for an act or acts of misconduct or moral or professional dereliction, or in the interest of national security.
c. Implements sections 630 and 14503 of Reference (d) by establishing DoD policy, assigning responsibilities, and prescribing procedures governing the administrative discharge of Regular and Reserve commissioned officers with fewer than 6 years of active commissioned service in certain circumstances.
d. Implements sections 1167 and 12687 of Reference (d) to separate military officers under confinement by sentence of court-martial after the sentence to confinement has become final under chapter 47 of Reference (d) and the officer has served in confinement for a period of 6 months.
APPLICABILITY. This Instruction:
a. Applies to OSD, the Military Departments, commissioned officers on the Active Duty List (ADL) and the Reserve Active Status List (RASL) of the Military Services.
b. Does not apply to commissioned warrant officers and retired commissioned officers of the Military Services.
